Actually separation of church and state means that the legal function of marriage should be 100% the governments, the church just has the rights to the ceremony.
And honestly, I don't give a flying fuck what name you give the legal function, but you and me both know it'll be called marriage by normal people. Trying to protect a word is pathetic.
