I like how people in the industry think it is the Used/Rental market that will hurt gaming. I'd bet most people on the outside would think it is the game and marketing budgets being that high being at fault.
We live in a society where people born on third base constantly try to steal second, yet we expect people born with two strikes against them to hit a homerun on the first pitch.

Pretty much. Spielberg and Lucas are on record saying the movie industry is going to implode soon since everyone is afraid to take risks on movies that wont be blockbusters or appeal to the largest(lowest?) demographic, then again I see a movie about giant robots fighting giant alien sea monsters and think they might be wrong about that.

We're in a period where AAA games have to sell about 5 million copies to be successful. The Tomb Raider reboot sold 3.4 million and was a disappointment. Kingdoms of Amalur: Reckoning sold 1.2 million after 90 days but needed to move over 3 million to be profitable.

Do not even get me started on good old Cliffy B and his "a game is only as good as how many millions you spend on it"

That dumbfuck thinks people buy Gears of War for the story.

I don't play many big AAA games since I tend to find things I absolutely despise that makes me stop playing. Last one I got was Far Cry 3 after I picked up Far Cry 3: Blood Dragon. I disliked absolutely nothing about those games. That implementation of open world was exactly how I like it, the game play was great and the story for each was passable to darn good and the games were beautiful.

I picked up Amalur and loved the combat but held zero interest in the story and absolutely hated the sameness of everything, enemies you fight as level one you fight as level 30+.

I also bought Colonial Marines. Enough said there.

So, in what me and my boss thought would be a simple 'email a guy, get information, profit', a single email asking for sales data (nothing crazy: sort of stuff that auto magazines publish - or so I thought) has turned into an epic email chain and I've lost track of how many unique individuals it's been forwarded to.

I've actually started using Bing maps for certain things, they are nicer looking and often have more detail than Google.

I'm mostly annoyed that they're eliminating the genuinely useful digital game sharing systems in their complete removal of all DRM restrictions. The family sharing and digital download game sharing could be implemented, at publisher doing, without restricting physical discs in any way.

The damage is done for me. Once they new consoles are out, I am going with a PS4 even though I currently own a 360.

The whole class action suit forfeiture upon acceptance of their XBone ToS pretty much sucks.

Didn't Sony do the same thing with an updated ToS after the PSN hack?

An'd I'm pretty sure a prohiibition to bring class action lawsuits isn't legally binding in all 50 states either.

I am fairly certain (at least based on some lawyer-friends comments - IANAL) there is a fair bit of legal precident for not being able to waive your right to file a lawsuit (but perhaps it was only in certain specific cases? dunno). I do believe that some waivers can be used to move for the *dismissal* of a suit, provided they meet the appropriate contract law requirements regarding the specific suit.
