That moment when a boss attempt is going all right, and then you hear a clear "ETCIU" and the tank sneezes and accidentally taunts Lei Shen right at the fusion cut cast getting throw off the platform like a baseball ball, and you wipe but can't stop laughing.

Lawyers for Paula Deen are looking to dismiss the lawsuit on a precedent by judge Roberts on prop 8. Basically they say that the racial discrimination suit is baseless because the plaintiff is white and thus was not discriminated against .

"In other words, for a federal court to have authority under the Constitution to settle a dispute, the party before it must seek a remedy for a personal and tangible harm."

Might be crazy enough to Potato.

So racism only exists legally if you are not caucasian.. Isn't that racism from the system against caucasians? by definition?

I understood from that description since her comments would be offensive to blacks, a white plaintiff wouldn't be discriminated against and wouldn't have a case. It wouldn't apply if it were a black plaintiff.

That's my interpretation from just Klaud's post. I didn't even know there was a lawsuit until now.

They are not arguing that, they are arguing she doesn't have a standing for the racial discrimination portion of the lawsuit, because the discrimination was not towards her. At most she was a witness of it, and perhaps a victim of a hostile environment (lawyer pov, not mine).

They are using a technicality made possible by Roberts on a prop 8 case.


"The idea here is that Lisa Jackson shouldn't be allowed to sue for racial discrimination because she could not have been harmed by it, regardless of whether any racial discrimination took place. Just as the Supreme Court refused to consider former Calif. State Sen. Dennis Hollingsworth's defense of gay-marriage ban Proposition 8 because they believed he could not be tangibly harmed by gay marriage."

Welcome to America!!!

Way back a long time ago, I tried to get a job at a local Carl's Jr, where the manager was a minority. Only minorities worked that that establishment. I was denied as a matter of course, and I complained. Caucasians are not protected.

Should be noted that the Paula Dean case is more about an abusive work environment than it is racism, and she is getting tarnished because she didn't lie like she should have regarding statements she made in the past. (Anyone who grew up in the South and is over ~60 years old probably used the N word a lot growing up. It's not right, but what was is what was).

Sounds less like they want it dismissed because "you can't be racist against white people" but more along the lines of "The racial comments were directed at black people, and the white person shouldn't be able to sue because s/he's not the affected party"

What exactly did Paula allegedly say/do anyway?

Edit: From what I'm reading, it sounds like she's being sued because she admitted to using racial slurs in the past during an interview?

She's being sued because of the treatment of an employee at one of the restaurants.

She's being grilled over the coals for admitting to using the racial remarks in the past, which came out in testimony/deposition.

and you don't think those actions are informed by fear of public opinion?

Paula Deen is probably not the best example (I actually don't care so have no idea, but from what I saw it seemed no different than any other 'outcry' over something someone remotely famous did)

It's gone something like this...

A while ago, PR moves like this were done out of response to public opinion.
More recently, PR moves were made out of fear of public opinion.
Now, they are creating public opinion.

In Dean's case the first sponsor to drop her did so the day after the testimony was revealed. I highly doubt any public outcry had started yet. Then the rest of the sponsors jumped ship as well.

It may be valid to not renew her contracts (she has plenty of other issues), but the rats jumping ship because of some courtroom testimony of past events seems extreme in the speed in which it occurred.
