I've yet to see a soft stale biscuit, personally. Usually they turn into hockey pucks after a day or two.

Thats the exact definition the UK courts agreed with when Customs & Excise tried to get Jaffa Cakes classified as a chocolate covered biscuit, which would make them eligible for VAT.
